Terms of Service

1. Who you are contracting with

These Terms of Service govern photography, film, and post production services provided by dmanproductions LLC, a Michigan limited liability company operating as Dan Mannes ("dmanproductions LLC", "we", "us", or "I"), based in Detroit, Michigan, United States. You can reach us at dan@danmannes.com.

By requesting a quote, paying a deposit or invoice, or otherwise engaging our services, you ("the Client") agree to these terms.

2. Services offered

We provide creative production services, described in full on the Services page:

• Photography: campaign, lookbook, documentary, sport, and event photography, including selection, editing, and color grading.
• Film: brand films, campaign and television spots, and documentary shorts and series, including direction, camera, and finishing.
• Post production: editing, color grading, producing, versioning, and delivery of existing footage.

We do not sell physical goods. All deliverables are supplied digitally unless a written quote states otherwise.

3. Quotes and scope

Every engagement begins with a written quote describing the scope of work, deliverables, timeline, usage rights, and total price. The quote, once accepted in writing (including by email), together with these terms, forms the agreement between us. Where a quote and these terms conflict, the quote controls.

Work outside the agreed scope, including additional shoot days, added deliverables, or revision rounds beyond those quoted, will be quoted and approved separately before it is carried out.

4. Prices, payment, and currency

All prices, quotes, and invoices are stated and payable in US dollars (USD). Rates shown on the Services page are starting points; the price for your project is the one stated in your written quote.

• A 50% deposit of the quoted total is required to reserve shoot dates and begin work.
• The remaining balance is invoiced on final delivery and is due within 15 days.
• Payments are accepted by major credit and debit card, processed securely by our payment processor, Stripe, and by bank transfer (ACH) on request.
• Card details are entered on Stripe's hosted checkout and are never collected, stored, or seen by dmanproductions LLC.
• Invoices unpaid after 30 days may accrue interest at 1.5% per month, to the extent permitted by law.

Travel, lodging, permits, specialist crew, and equipment rental are billed at cost and are estimated in the quote where they apply.

5. Cancellations and refunds

Cancellation windows, deposit treatment, refund eligibility, and dispute handling are set out in full in our Refunds & Cancellations Policy, which forms part of these terms.

6. Scheduling, weather, and rescheduling

Shoot dates are confirmed only once the deposit is received. If conditions outside either party's control make a shoot unsafe or unworkable, including severe weather, illness, or location closure, we will reschedule to the next mutually available date at no additional booking fee. Third-party costs already incurred, such as non-refundable travel, remain payable.

7. Delivery

Final files are delivered digitally by download link. Unless the quote states otherwise, delivery is typically two to four weeks after the final shoot day for photography and post-only work, and as scheduled in the quote for film projects. Rush timelines are available and quoted separately.

Delivery links remain live for at least 30 days. We recommend the Client download and archive their files promptly. We are not obliged to retain project files indefinitely, though we generally keep masters for 12 months.

8. Copyright and licensing

dmanproductions LLC retains copyright in all photographs, footage, and finished work unless copyright is expressly assigned in writing. The Client receives the usage licence specified in the quote, covering the media, territory, and term stated there.

The licence takes effect only once the engagement has been paid in full. Usage beyond the licensed scope requires a further written agreement and fee.

Unless the Client requests otherwise in writing, we may display work in our portfolio, on this website, on our Vimeo and Instagram profiles, and in award or client submissions.

9. Client responsibilities

The Client agrees to provide timely access to locations, talent, products, and approvals; to secure any permits, releases, or clearances that are the Client's responsibility under the quote; and to give consolidated feedback within agreed revision windows. Delays in these areas may shift delivery dates.

The Client warrants that any materials supplied to us, including logos, music, and footage, are cleared for the intended use.

10. Liability

Our total liability arising from any engagement is limited to the total fees paid by the Client for that engagement. We are not liable for indirect or consequential losses, including lost profits or lost business opportunity.

In the unlikely event of equipment failure, data loss, or an inability to deliver caused by us, our liability is limited to a refund of fees paid for the affected deliverables, as described in the Refunds & Cancellations Policy.

11. Legal and export restrictions

Services are provided to clients in the United States and internationally. We do not provide services to individuals or entities subject to United States sanctions, or in jurisdictions where doing so would breach applicable law. Both parties agree to comply with applicable export control and sanctions regulations.

12. Governing law

These terms are governed by the laws of the State of Michigan, United States, without regard to its conflict of law rules. The parties agree to attempt to resolve any dispute in good faith and directly before pursuing formal proceedings.

13. Changes to these terms

We may update these terms from time to time. The version in force for your project is the version published on the date your quote is accepted. The current version is always available at this address.
